When Post-Accident Testing Is Required

Under 49 CFR Part 382.303, DOT Post-Accident testing is triggered in three situations involving a CDL driver. Testing is always required when the accident results in a fatality. It’s also required when the driver receives a citation for a moving violation and the accident involves either a bodily injury requiring immediate off-scene medical treatment or disabling vehicle damage requiring a tow.

The time windows are strict. Alcohol testing must be completed within 8 hours of the accident; drug testing must be completed within 32 hours. If either window closes before testing is done, the employer must prepare and retain a written explanation. Those records are reviewed during DOT audits. A driver who isn’t available for testing may be treated as having refused, which carries the same consequences as a positive result.

One important note for Michigan employers: recreational and medical marijuana are both legal in this state, but that doesn’t change your federal DOT testing obligations. Safety-sensitive employees are held to federal standards regardless of state law.

Which Employers & Drivers Are Subject to DOT Post-Accident Testing

Post-accident testing requirements apply to employers regulated by any of six federal agencies: FAA, FMCSA, FTA, USCG, PHMSA, and FRA. For most Livingston County businesses, FMCSA regulations are the most relevant. FMCSA governs commercial motor vehicle (CMV) drivers who hold a CDL, covering trucking, freight, construction equipment hauling, transit, and related industries.

Covered employees include CDL-holding truck drivers, bus drivers, locomotive engineers, pipeline controllers, aviation mechanics, and others in safety-sensitive transportation roles. As of November 18, 2024, drivers with a prohibited status in the Clearinghouse can lose their state-issued commercial driving privileges until they complete the return-to-duty process with a DOT-qualified Substance Abuse Professional (SAP). The employer is required to provide the driver with a list of qualified SAPs. Failing to do so can result in regulatory sanctions.
