The Five DOT-Required Testing Circumstances

DOT regulations define five situations that require or may require alcohol testing. Understanding each one helps you build a program that supports your company year-round.

Pre-Employment Screening

Before a CDL driver performs any safety-sensitive function, the employer must receive a negative drug test result. Federal rules don’t mandate pre-employment alcohol testing for all agencies, but individual agency rules or your own policy may require it. Confirm your agency’s requirements before onboarding a covered employee.

Random Alcohol Testing

CDL drivers must be randomly tested throughout the year. Owner-operators are required to participate in a random testing consortium rather than administering their own program. FMCSA sets minimum random alcohol testing rates by Federal Register notice each year.

Post-Accident DOT Alcohol Testing

After a qualifying crash, the clock starts immediately. For FMCSA-covered drivers, the alcohol test should be administered as soon as practicable and within eight hours of the accident. Missing that window doesn’t eliminate the documentation requirement: the employer must record why the test wasn’t completed in time.

For-Cause Breath Alcohol Testing

A supervisor who observes specific, contemporaneous, articulable signs of alcohol misuse may require an immediate test. Reasonable suspicion isn’t a guess: supervisors must be trained to recognize the signs, and those observations must be documented before or shortly after the test is ordered.

Return-to-Duty & Follow-Up Testing

An employee who violated DOT drug or alcohol rules must be evaluated by a substance abuse professional (SAP) before returning to safety-sensitive duties. Follow-up testing continues on a schedule the SAP sets, typically for one to five years.

Which Employers Fall Under DOT Alcohol Testing Requirements

Six federal agencies administer DOT safety-sensitive testing programs. If your workforce includes employees covered by any of these agencies, you’re required to have a compliant program in place.

FMCSA (Federal Motor Carrier Safety Administration)
Covers CDL drivers of commercial motor vehicles. This is the largest regulated group in the Broken Arrow and Tulsa area, given the region’s manufacturing and logistics workforce.

FAA (Federal Aviation Administration)
Covers aviation employees in safety-sensitive positions, including flight crew, aircraft maintenance personnel, air traffic controllers, and airport security staff.

FTA (Federal Transit Administration)
Covers safety-sensitive employees of public transit systems, including operators, mechanics, and dispatchers.

PHMSA (Pipeline and Hazardous Materials Safety Administration)
Covers employees who operate or maintain pipelines. PHMSA doesn’t authorize random alcohol testing for its covered workforce.

USCG (United States Coast Guard)
Covers crewmembers of regulated vessels. Like PHMSA, USCG doesn’t authorize random alcohol testing under its program.

FRA (Federal Railroad Administration)
Covers railroad employees in safety-sensitive positions. FRA has its own specific testing windows and additional rules that differ from those of other DOT agencies.
