Who Must Participate in a DOT Random Testing Program

Six federal agencies regulate safety-sensitive employees subject to random drug and alcohol testing requirements: FMCSA, FAA, FRA, PHMSA, FTA, and USCG. If your employees perform safety-sensitive functions under any of these agencies, federal law requires you to have a compliant random testing program in place.

Owner-operators and companies with only one CDL driver not leased to another motor carrier face an additional requirement under FMCSA rules: they must belong to a consortium. There’s no option to run a solo program. Companies with more than one covered employee may manage their own program internally, but many choose consortium enrollment to reduce administrative burden and simplify recordkeeping. FMCSA currently mandates annual random testing rates of 50% for drugs and 10% for alcohol across the enrolled pool.

One point that catches some Austin employers off guard: federal DOT drug testing rules apply regardless of Texas state law. Marijuana remains a prohibited substance under 49 CFR Part 40 for safety-sensitive employees, and a positive result is reported and handled the same way it would be in any other state.

How the Program Works Each Quarter

At the start of each quarter, we contact you to update your driver roster, accounting for new hires and departures. Random selection lists are pulled at varied, unannounced times to preserve the integrity and unpredictability of the process. You receive notification of which employees were selected and, when no employees are drawn in a given quarter, a non-selection notification is issued as well.

That non-selection documentation matters. DOT auditors may request records covering the full annual testing cycle, not only positive results. Retaining those quarterly notifications is part of audit-ready recordkeeping, and we provide them automatically. If no employees are selected in a quarter, no additional test fees apply for that period.

Our fee structure is straightforward: a one-time setup fee, one annual service fee, and per-test billing at the time of service. No bundled costs obscuring what you’re paying for.

Enrolling in Our Austin DOT Random Testing Program

To enroll, you provide your company name, address, Designated Employer Representative (DER), and USDOT number. The DER is the employer-designated contact who receives confidential selection notifications and is responsible for directing selected employees to testing without delay. Each driver must also have a negative DOT drug test on file at enrollment.

Transferring from a prior consortium? You can substitute a Statement of Compliance and Roster Verification from Previous Consortium in place of new pre-enrollment drug tests for existing drivers. At the completion of enrollment, we provide a signed letter of agreement and a certificate of enrollment listing each enrolled employee.
