When DOT Breath Alcohol Testing Is Required
Federal law requires employees who perform safety-sensitive functions for employers regulated by one of six DOT agencies to comply with drug and alcohol testing under 49 CFR Part 40. Those agencies are FAA, FRA, FMSCA, PHMSA, FTA, and USCG. Under federal standards, an employee who tests at 0.04 BAC or higher must be removed from safety-sensitive duties immediately. A result between 0.02 and 0.039 BAC requires removal from safety-sensitive duties for a minimum of eight hours.
How the DOT Breath Alcohol Testing Process Works
DOT regulations require a two-step procedure. First, the certified breath alcohol technician administers a screening test. If the result is 0.02 BAC or higher, a confirmation test must follow, conducted no sooner than 15 minutes after the screening. Only an evidential breath testing device on the NHTSA-approved list may be used for the confirmation test. FastestLabs uses the Lifeloc Phoenix® 6.0 for both steps.
