Legal Situations That Require Court-Admissible DNA Results

Legal DNA testing comes into play across a wide range of family law and government matters. AABB-accredited results carry the legal weight these situations demand.

Common reasons Sandy residents request court-admissible DNA testing:

  • Paternity establishment for child support or custody and visitation rights
  • Birth certificate amendment to add or correct a biological parent’s name
  • Inheritance claims asserting a biological relationship to a deceased family member
  • Immigration DNA testing for visa or citizenship applications, where AABB accreditation is specifically required by USCIS
  • Military or government benefits requiring proof of a biological relationship

Even when a court hasn’t ordered testing, voluntarily obtaining AABB-accredited results can be presented as evidence in family law proceedings. Our notarized results are formatted for acceptance by courts and governmental agencies.

How the Collection Process Works

The process is straightforward and non-intrusive. When you arrive, our certified Fastest Labs collectors verify the identity of all parties using valid government-issued photo ID. Samples are collected via a simple cheek swab, also called a buccal swab. Collection typically takes just a few minutes.

From there, the documented chain of custody begins. Every handoff of your specimen is recorded, establishing an unbroken record that protects the integrity of your results from collection through lab analysis. Samples go directly to our AABB-accredited lab, and once analysis is complete, notarized results are released to authorized parties. Depending on your situation, that may include the tested adults, attorneys, courts, or government agencies.

How Utah Law Handles Paternity & Genetic Testing

When unmarried parents have a child in Utah, the father doesn’t automatically acquire legal rights. Paternity must be established either through a Voluntary Declaration of Paternity signed by both parents or through a court proceeding. For Sandy residents, those family law cases are filed in Utah’s Third Judicial District Court, which covers Salt Lake County.

Under Utah Code 81-5-503, parties in a court case must use an accredited laboratory for genetic testing. AABB accreditation satisfies this requirement. If one party refuses testing after a case has already been filed, the other party can file a Motion for Genetic Testing asking the court to compel it. When both parties agree voluntarily, no court order is needed.

Once results are in, Utah Code 81-5-505 sets the legal threshold: a report showing at least 99% probability of parentage and a combined parentage index of 100 to 1 or greater creates a legal presumption that the tested man is the biological father.
