Federal DOT Compliance Requirements for Detroit Employers

Two federal regulations govern most of the DOT testing demand in Detroit. 49 CFR Part 40 sets the rules for how all DOT-required testing is conducted, documented, and reported, regardless of which transportation agency oversees your operation. 49 CFR Part 382 applies specifically to FMCSA-regulated employers with CDL drivers operating commercial motor vehicles, including vehicles with a gross vehicle weight rating of 26,001 pounds or more, vehicles designed to transport 16 or more passengers, including the driver, and any vehicle transporting hazardous materials that requires a placard under 49 CFR Part 172.

Federal DOT testing requirements extend beyond FMCSA. Employers in aviation (FAA), transit (FTA), rail (FRA), pipeline (PHMSA), and maritime (USCG) industries are all subject to 49 CFR Part 40. Detroit’s transportation sector, from Wayne County trucking and logistics to public transit under the FTA, represents a broad range of covered employers. Fleet size doesn’t reduce the obligation: a single-vehicle owner-operator carries the same compliance requirements under 49 CFR Part 382 as a large carrier.

Michigan has no state employment drug testing law that overrides federal DOT requirements for safety-sensitive positions. All test results must be reviewed by a licensed Medical Review Officer (MRO), and records must be retained for the periods specified in Part 40 and the applicable agency regulation.

The Six DOT Testing Occasions Every Employer Must Be Ready For

Federal regulations require testing across six distinct occasions. Each has specific triggers and time requirements employers can’t afford to miss.

  • Pre-employment: All candidates for safety-sensitive positions must test negative before beginning those duties.
  • Random: CDL drivers and safety-sensitive employees must be randomly tested throughout the year at federally set minimum rates. Owner-operators must participate in a random pool through a consortium.
  • Post-accident: Drug and alcohol tests are required after qualifying crashes within federally defined time windows.
  • Reasonable suspicion: Supervisors who observe signs of impairment must send the employee for immediate testing. Under 49 CFR Part 382, supervisors must be trained to recognize those signs.
  • Return-to-duty: Employees who violated DOT drug or alcohol rules must complete the return-to-duty process with a DOT-qualified Substance Abuse Professional and test negative before resuming safety-sensitive functions.
  • Follow-up: Employees who return to safety-sensitive duties after a violation are subject to unannounced follow-up testing as directed by the Substance Abuse Professional.

Beginning November 18, 2024, CDL drivers with unresolved drug or alcohol violations in the FMCSA Clearinghouse are subject to automatic CDL downgrade by their state licensing agency under Clearinghouse II. Employers can’t hire or retain a driver with an unresolved Clearinghouse violation until that driver completes the return-to-duty process.
