DOT Alcohol Testing Requirements Under 49 CFR Part 40

DOT alcohol testing is governed by 49 CFR Part 40, the federal regulation that sets uniform procedures for collection, testing, and reporting across all six DOT agencies. When DOT Alcohol Testing Is Required

• Random alcohol testing on an unannounced basis throughout the year
• Post-accident testing following qualifying incidents
• For-cause breath alcohol testing when reasonable suspicion exists
• Return-to-duty testing before an employee resumes safety-sensitive functions after a violation
• Follow-up testing after return to duty, as directed by a SAP

What Triggers a Failed DOT Alcohol Test

A DOT alcohol test result is considered a failure under any of these conditions: refusal to take a breath alcohol test, refusal to complete and/or sign the testing form, refusal to provide adequate breath, a test result of 0.04 blood alcohol content or higher, or refusal to cooperate with any part of the testing process.

A BAC result between 0.02 and 0.039 doesn’t constitute a formal violation, but it does require the employee to be removed from safety-sensitive duties for a minimum period. A confirmed result at or above 0.04 BAC triggers removal from safety-sensitive functions and a referral to a Substance Abuse Professional. For FMCSA-covered employers, violations must be reported to the FMCSA Drug and Alcohol Clearinghouse.
