DOT Alcohol Testing Regulations: What Employers Need to Know

DOT alcohol testing follows a strict procedural framework under 49 CFR Part 40. The device used to detect alcohol is called an evidential breath testing device (EBT), and it must appear on the National Highway Traffic Safety Administration’s Conforming Products List to be used in federally mandated testing. Only a certified breath alcohol technician is permitted to operate one.

The threshold for a failed DOT alcohol test is 0.04 or higher. Refusal to complete the test carries the same consequence as a failed result. Refusal includes declining to take the breath alcohol test, not completing or signing the testing form, failing to provide adequate breath, or refusing to cooperate with any part of the testing process.

What Happens After a Failed or Refused Test

A failed or refused DOT alcohol test triggers immediate removal from safety-sensitive duties. The employee can’t return to those duties until they’ve completed the return-to-duty and follow-up process, which includes evaluation by a substance abuse professional and a negative return-to-duty test. Follow-up testing is required for a period determined by the substance abuse professional, with a minimum of six tests in the first year following reinstatement.

DOT-regulated employers must conduct random alcohol testing at a rate set by the applicable agency.
