Which Industries Are Covered by Federal DOT Alcohol Testing Requirements

Under 49 CFR Part 40, DOT breath alcohol testing requires two tests. A screening test provides the initial BAC reading. If that result is 0.02 or above, a confirmation test must follow at least 15 minutes later using an approved evidential breath testing (EBT) device. The confirmation result carries the legal and regulatory weight. A BAC of 0.04 or higher is a DOT-positive result.

The FMCSA Drug and Alcohol Clearinghouse is a federal database tracking CDL driver violations, and as of November 18, 2024, drivers with a prohibited status in the Clearinghouse face automatic downgrade or suspension of their state-issued CDL.
