When DOT Post-Accident Testing Is Required

Not every accident triggers a federal testing obligation. Under 49 CFR 382.303, three specific scenarios require a commercial driver’s license (CDL) holder to submit to post-accident federal DOT drug and alcohol testing.

The three federal triggering scenarios:

Fatality: Any accident involving a human fatality requires testing, regardless of whether the driver received a citation.
Bodily injury with citation: Testing is required when the driver receives a moving violation citation and someone is injured badly enough to require immediate medical treatment away from the scene.
Disabling vehicle damage with citation: Testing is required when the driver receives a moving violation citation and a vehicle involved in the accident must be towed from the scene due to disabling damage.

Private property accidents generally don’t meet the federal threshold. Employers may still test after any incident under company policy using a non-DOT chain of custody form, but that policy must be applied consistently to all drivers.

Testing Windows & What the Tests Cover

Time is the defining factor in DOT Post-Accident compliance. Alcohol metabolizes quickly, which is why the window is narrow. If alcohol testing isn’t completed within 8 hours of the accident, you must stop attempts and document the reason in writing. Drug testing allows a longer window of 32 hours, but missing it carries the same documentation and record-keeping consequences.

Both tests must be completed after a qualifying accident. Employers can’t choose one over the other.

What each test screens for:

DOT urine drug test (five-panel): Screens for marijuana metabolites, cocaine metabolites, amphetamines, opioids, and phencyclidine (PCP).
DOT breath alcohol test: Uses a DOT-approved device administered by a qualified Breath Alcohol Technician (BAT) to screen for non-compliant alcohol concentration levels.

A law enforcement roadside test may satisfy the DOT requirement only if it conforms to applicable federal, state, or local alcohol testing requirements and the employer obtains documentation of the actual result. Employer Documentation & Compliance After an Accident

Completing the test is step one. What you document afterward affects how your program is reviewed in an audit. Federal regulations require employers to record the accident date, time, and circumstances; whether a fatality, injury, or disabling damage occurred; whether the driver received a citation; and whether testing was completed within the required timeframes. If testing couldn’t be completed in time, the reasons must be documented in writing and retained for FMCSA review.

DOT regulations set different retention periods depending on the record type. Positive test results and refusals must be kept for five years, collection process records for two years, and accident registers for three years. Know your obligations before an audit, not after.

Positive Results & Refusals

A CDL driver who tests positive or refuses a post-accident test must be immediately removed from safety-sensitive functions. The return-to-duty process then requires evaluation by a DOT-qualified Substance Abuse Professional (SAP) before that driver can return to operating a commercial vehicle. Positive results and refusals must also be reported to the FMCSA Drug and Alcohol Clearinghouse, the federal database tracking CDL driver violations.

Driver Obligations After a Qualifying Accident

Drivers share compliance obligations too. A driver subject to post-accident testing must remain readily available. Leaving the scene or becoming unreachable can be treated as a refusal to test, which carries the same consequences as a positive result. Under 49 CFR 382.303, drivers are also prohibited from consuming alcohol for 8 hours following a qualifying accident, or until the post-accident alcohol test is completed, whichever comes first.
