Which Accidents Require DOT Post-Accident Testing

Not every commercial vehicle incident triggers a mandatory test. Under 49 CFR Part 382.303, the rules depend on what happened and whether the CDL driver received a citation for a moving violation.

Three scenarios require post-accident testing:

A fatality occurred: Testing is required when a CMV accident results in a human fatality, regardless of whether the driver was cited.
Bodily injury requiring immediate off-scene treatment: Testing is required when someone is injured and taken directly from the scene for medical treatment, and the CDL driver received a moving violation citation.
Disabling vehicle damage requiring a tow: Testing is required when any vehicle involved must be towed from the scene, and the CDL driver was cited for a moving violation.

Minor incidents with no fatality, no off-scene injury treatment, and no vehicle tow don’t automatically require a DOT post-accident test. One important point: a breath or urine test conducted by law enforcement under their own independent authority can satisfy the DOT post-accident requirement under 49 CFR 382.303, but only if the test conforms to applicable requirements and the employer obtains a copy of the results. When there’s any uncertainty about whether those conditions are met, a separate DOT-compliant test is a prudent course. Federal Testing Windows: How Much Time You Have

The windows begin at the moment of the accident, not when the employer learns about it or the driver reports in. Speed matters.

Testing deadlines by type:

Alcohol testing: Testing should be attempted within 2 hours. After 8 hours, no attempt may be made and the employer must document why testing didn’t happen.
Drug testing: Testing must be completed within 32 hours. If that window closes, the employer must stop all attempts and prepare a written record explaining the failure, a record FMCSA auditors can review.
