Who Is Required to Conduct Random Drug & Alcohol Testing?

Any employer with safety-sensitive employees regulated by a federal DOT agency must maintain an active random drug and alcohol testing pool. Federal regulations require that covered employees be subject to unannounced, computer-generated random selections throughout the year. Failing to maintain a compliant program can result in fines and DOT sanctions.

Six federal agencies mandate random testing programs:

  • Federal Motor Carrier Safety Administration (FMCSA) is for CDL drivers and motor carriers.
  • Federal Aviation Administration (FAA) is for aviation safety-sensitive functions.
  • Federal Railroad Administration (FRA) is for rail employees.
  • Pipeline and Hazardous Materials Safety Administration (PHMSA) is for pipeline operators.
  • Federal Transit Administration (FTA) is for transit operators.
  • United States Coast Guard (USCG) is for merchant mariners.

Owner-operators with no other covered employees are required by FMCSA regulations to belong to a DOT consortium for random testing purposes. A DOT consortium, sometimes called a C/TPA, pools covered employees from multiple employers into a single random selection program. This is how smaller companies and sole operators meet the statistical validity requirements under 49 CFR Part 40. Employers with fewer than 50 safety-sensitive employees typically join a consortium pool; larger fleets may maintain a stand-alone program.

What a Compliant DOT Random Testing Program Must Include

Under 49 CFR Part 40, a complete DOT Random Drug & Alcohol Testing Program requires more than just the test itself. Required components include a written drug and alcohol policy, employee drug testing, supervisor training, substance abuse referral procedures, employee education, a scientifically valid random selection method, post-accident testing protocols, a designated employer representative (DER), and federal chain of custody forms for every collection.

The DER is the person inside your organization responsible for removing employees from safety-sensitive duties after a positive test or refusal. Annual drug and alcohol testing data must also be submitted to the applicable DOT agency each year.

We provide certified collectors for specimen collections, use federal chain of custody forms, and offer policy creation and implementation as part of our program design services. Our testing suite includes breathalyzer tests, urinalysis, and saliva alcohol tests.

DOT-Approved Testing Methods at Fastest Labs of Webster

Every DOT testing event requires specific collection procedures and documentation. We conduct DOT breath alcohol tests using certified breathalyzer equipment, DOT urine drug testing (urinalysis) using federal chain of custody forms, and saliva alcohol tests as part of our full DOT testing suite. Collections are performed by certified collectors in our clean, professional Webster facility.

A standard DOT drug test uses a 5-panel urine screen analyzed at a SAMHSA-certified laboratory and reviewed by a Medical Review Officer (MRO), a licensed physician responsible for interpreting results and contacting employees before reporting confirmed positives. DOT breath alcohol testing follows federally approved procedures using a federal alcohol testing form. Because DOT regulations require an employee selected for random testing to proceed to the collection site immediately upon notification, having a nearby, efficient facility isn’t just a convenience. It’s a compliance factor.

Policy Creation & Program Management Services

Compliance doesn’t stop at the collection. We offer the back-end program support that lets employers stay compliant without building an in-house compliance function from scratch.

DOT Policy Creation
We help employers draft a written drug and alcohol policy that meets 49 CFR Part 40 requirements. A written policy is required for DOT-regulated employers with safety-sensitive employees, and it must address testing circumstances, consequences, and employee rights.

Policy Implementation Support
A policy on paper isn’t enough. We provide implementation support so your program is operationally ready, including guidance on designating a DER and setting up the supervisor reasonable suspicion training that DOT regulations require for supervisors of safety-sensitive employees.

Random Program Management
We administer the random selection and notification process so you don’t have to. Selections use a scientifically valid, computer-generated method that is unbiased and unpredictable, as required under federal rules. We work with businesses of all sizes, from individual owner-operators to large multi-employee fleets.
