DOT Alcohol Testing Rules Every Houston Employer Should Know

DOT alcohol testing operates under strict procedural requirements defined in 49 CFR Part 40. The device used must be a National Highway Traffic Safety Administration-approved evidential breath testing device (EBT), and it can only be operated by a certified breath alcohol technician. Post-Accident DOT Alcohol Testing

Return-to-Duty Testing

Before an employee who violated DOT alcohol rules may return to safety-sensitive functions, they must pass a return-to-duty test conducted by a certified breath alcohol technician using an EBT. That test can’t happen until a Substance Abuse Professional has completed their evaluation and cleared the employee to test.

Follow-Up Testing

A return-to-duty test isn’t the end of the process. The Substance Abuse Professional determines the number and frequency of follow-up tests. Under 49 CFR Part 40, employees must complete a minimum of six unannounced follow-up tests in the first 12 months, and testing may continue for up to 60 months depending on the SAP’s recommendations.
